Trump will be exonerated today and then we will get onto

locking up Barry, Hilary, Bill, Loretta, etc.

This whole play by the democrats called "The Russians" tried to discredit Trump. The DNC and high ranking democrats are traitors to this nation. All of this noise has been to try and destabilize and potentially oust Trump from office in order to cover-up the most corrupt administration in U.S history.

They lied, they cheated, the thought they were going to win and they lost even with all the corruption and cheating.

Lock them up!

was needed. Trumps people may have gotten caught and something dragged him in, or he dragged himself in. As a man running for President he and his people were most definitely observed. He has a lot of business interests there, so it's a safe bet Trump himself was observed when he was in Russia. By us and by Putin's people.

Response to NeoKhan (Reply #45)

Mon Mar 20, 2017, 06:24 PM

50. Here Neo

FISA commentary from Law Warfare:

Questioning the legality of the US Intelligence Community’s (USIC) interception or use of communications involving Flynn. As David Kris has already explained, this misunderstands how FISA both protects US person privacy and ensures that the government remains able to obtain and use intelligence necessary to protect the nation. Given the level of confusion generated by these reports, I think it would be helpful to further flesh out when the USIC can legally acquire and use intercepted communications involving US persons who are not themselves the government’s target.

The Wall Street Journal asks ominously whether “the spooks listening to Mr. Flynn obeyed the law.” And the Journal inaccurately states that FISA does not let the USIC “listen to the communications of Americans who may be caught in such eavesdropping” (this also assumes the American was not an authorized FISA target himself). Yet there is no prohibition on listening to both ends of a conversation when the USIC is conducting court-authorized surveillance of a communication facility used by an agent of a foreign power. There are, however, significant restrictions on how the USIC can use any US person information thereby acquired.

Specifically, the FBI, CIA, and National Security Agency each operates under FISA “minimization” procedures that establish protections over the retention and dissemination of US persons' private information. Nonpublicly available information of an unconsenting US person cannot be disseminated without all identifying information being masked, or “minimized.” Minimization, in turn, is subject to extensive executive and judicial oversight.

There is, however, an important exception for US person information that (1) meets the statutory definition of “foreign intelligence,” (2) is necessary to understand foreign intelligence (as Kris highlighted on Tuesday), or (3) is evidence of a crime. US person information that falls into one of these buckets does not have to be masked. The law does not require that the USIC turn a blind eye, nor should it. The USIC can use and disseminate pursuant to the minimization procedures this “unminimized” information, including the identity of a US person, if the standard is met as to that information.

You are referring to section 702 of FISA. That is not the case in this matter. 702 deals with:

Section 702 of the Foreign Intelligence Surveillance Act

Section 702 refers to part of the Foreign Intelligence Surveillance Act (FISA) Amendments of 2008, Section 702 (50 USC 1881a). This provision of FISA faciliates the acquisition of foreign intelligence information concerning non-U.S. persons located outside the United States, creating a new, more streamlined procedure to collect the communications of foreign terrorists.

The Congress will continue to investigate who leaked Flynn's name. It may have come from inside the WH or from the IC. More than likely out of the NYC office of the FBI. Some hard core guys who do not like the Russians and really get pissed when someone inside the US works with them.

56. Tell him to go for it.

50 USC §1801(b) "'Agent of a foreign power' means—
(1) any person other than a United States person, who— (A) acts in the United States as an officer or employee of a foreign power, or as a member of a foreign power as defined in subsection (a)(4), irrespective of whether the person is inside the United States;
(B) acts for or on behalf of a foreign power which engages in clandestine intelligence activities in the United States contrary to the interests of the United States, when the circumstances indicate that such person may engage in such activities, or when such person knowingly aids or abets any person in the conduct of such activities or knowingly conspires with any person to engage in such activities;

The linked article you gave bypasses this point.

The leaking of Flynn's name is presumably illegal, identifying Flynn in the documentation under FISA was not.

As to who leaked, It will take awhile. O stated the information was distributed to insure it was not purged. Trump had advanced notice of Flynn's activity and that Flynn had had contact with the Russians. Instead of pulling Flynn from consideration, Trump let it go forward. Then directed Pence to inquire about the contacts having been reminded for the third time. Push came to shove. Flynn was outed. The rest is history.

The problem with Flynn was Flynn. Do you remember Ollie North? Iran contra?

The folks who run the military and more importantly the intel community did not want to see a repeat of that fiasco. And Flynn would have gone off the reservation and burned a few bridges in the process.

It was way too early in the Trump administration to push their luck. The "O wire tapped me" was a change in course away from defending Flynn. Worked pretty well, in one sense.

If an intelligence agency is monitoring a foreign national, and said foreign national is incidentally overheard communicating with an American citizen, then in and of itself, no crime has been committed.

and nothing more. The Repubs will take this now, because it's blown up way bigger than the Dems wanted, and use it as an excuse for full blown investigations. I expect those investigations to lead to showing just how "in bed" the Dems are with foreign interests and how their campaigns are, in part, funded by foreign money.
