Upper East Side aunt sues 12-year-old nephew for $127G...

...after breaking her wrist while leaping to greet her at birthday party

If only they could just hug it out.

A human resources manager from Manhattan is suing her nephew over a leaping greeting from the then-8-year-old that left her with a broken wrist, according to reports.

Jennifer Connell, 54, believes little Sean Tarala, now 12, should have known better than to jump into her arms as a means of welcoming her to his birthday party in 2011, ctpost.com reported Monday.

Connell, of E. 73rd St. on the Upper East Side, is seeking $127,000 in damages for suffering a broken wrist when the two fell to the ground in the rough reception, according to the site.

1. Homeowners insurance

The typical Homeowners Insurance policy minimum is $100,000 for Personal Liability. Medical payments on homeowners are typically $1,000 minimum per person.

Defense costs are considered "Supplementary" and awarded in excess of the liability limit; which are typically 1/3rd of the winnings.

What I think the petitioning lawyer may not have realized is that Supplementary payments are for the Defense not the offense; so the $27k if won will end up coming out of the parents pocket vicariously.

This will likely be settled for $15k.

2. The kids' mother just died.

Maybe she's going after any inheritance or life insurance. If decided in her favor, he isn't legally bound to pay her til he's eighteen.

Why else wait 4 years?

4. Trial is just happening...could've been filed way earlier

I don't know enough about the case.

I read your OP, then you responded, then I read the article.

I'm not justifying any of it but if it's going to trial and there's no settlement then I dunno.

Also the boy wouldn't pay, his father is alive and this happened on their property; vicarious liability shifts it to the father/parents/legal guardian.

3. Guarantee this has to do with the Insurance company, and Lawyers(Yemach Shemo)

Years ago a korean church near me exploded one early morning from a gas leak (The flash of light was like daylight). 4 homes nearby were hit with flaming debris and 2 burned.

A Friends family got out of there house with the clothes on their backs and was later sued by the FDNY Firefighters.

City Lawyers(Yemach Shemo) demanded they sue for the costs of treating them for smoke inhalation

the korean church was not sued (and it was an illegal gas hookup not ConEd approved or inspected)

5. I've read takes on this from both sides. Those supporting the lawsuit seem to blame it on the

 

insurance companies who are fighting to (NOT) cover the medical costs, and whatever else the aunt is looking for.

Another take is that because our medical care system is so messed up, being perverted by the profit-priority (over actually providing care to people) of the major players, suing is the only way to get the medical care paid for.

But then, there is this little nugget...

The aunt is oh-so concerned about her "social life" and the negative impact the accident has had.

“I was at a party recently and it was difficult to hold my hors d’oeuvres plate,” she stated.

Sounds like just another rich (Upper East Side) 1%er looking for more money, even at the cost of family peace.

I also wonder if the mother who recently died (aunt's sister?) is the reason the lawsuit has not proceeded until now.

Bring a modern, NON-PROFIT medical care system to the US and this would never have arisen in the first place.

Unless the aunt is just looking for a big payoff.
In that case, to hell with her.
