Hillary`s IT guy, Bryan Pagliano, plans to plead the 5th at deposition with Judicial Watch

`A former information technology adviser to Hillary Clinton plans to exercise his Fifth Amendment right against self-incrimination at a deposition next week and wants to prevent any video recording being made of the session.

Lawyers for former State Department tech specialist Bryan Pagliano said in a court filing Wednesday that there's no valid reason to make an audio or video recording of the session since Pagliano doesn't plan to answer any of the questions he's asked by the conservative group Judicial Watch, which is pursuing a Freedom of Information Act lawsuit related to Clinton's private email server.`

He doesn`t want to self-incriminate himself.

Isn`t it a little late for that ?

1. I'm not sure he legally can take the 5th at this time....

Unless his immunity is only good during testimony in a specific investigation....

It may work this time but if he tries this with the FBI he will go to prison.

2. The FBI already gave him immunity.

Judicial Watch may have access to his previous testimony.

3. It could be but all in my experience and I've only seen it three times

each time immunity was given it was different, it had different limitations and guidelines.

My go to was that he already received immunity and so the fifth would not apply since he could not face "incrimination" from his words and answers.

But I had to back off of that one because I am not sure exactly what his immunity covers.

4. The Judicial Watch lawsuit is a civil suit...the FBI would be a criminal investigation.

I think that they probably could share info between them, but I don`t really know.

6. Can you plead self-incrimination in a civil action? I'm no legal bagel (pun intended)

 

but I would think the 5A only covers criminal cases.

7. Yes you can take the 5th in civil cases.

You can not be compelled to testify against yourself.

Basically, all he has to do is show up. From there on out, after identifying himself, his lawyer does the talking.
