Another Blow to Impeachment: Mark Sandy Testimony Released, Blows Away Schiff Narrative for Aid Freeze



Rep. Lee Zeldin (R-NY) has been agitating for House Intelligence Committee Chair Adam Schiff (D-CA) to release the transcript of the closed door testimony of White House Office of Management and Budget (OMB) official Mark Sandy.

It just dropped and we can see why Schiff may have sat on it.

Sandy provided the reason for why aid was held up that blows apart the Schiff narrative and is completely consistent with everything we’ve seen from how President Donald Trump works.

Sandy explained that the only reason he was told that aid was temporarily frozen was because of other countries not contributing more to Ukraine.

Q: Okay. At any point in time, from the moment that you walked into the SCIF to anytime in history, has Mr. Duffey even provided to you a reason why the President wanted to place a hold on security assistance?
A: I recall in early September an email that attributed the hold to the President’s concern about other countries not contributing more to Ukraine.

This is consistent with what he said to President Zelensky on July 25, where he mentioned that Germany and other European countries weren’t doing their fair share to help.

It’s consistent with how Trump has approached NATO and the UN, to hold or talk about holding American aid until other countries kick in with their shares.

The aid was ultimately given to Ukraine and there was not in fact any lag in them getting it. But Democrats tried to argue that the aid was held until Ukrainians agreed to investigate the Bidens. But no witness actually supported the claim that Trump conditioned aid on investigations, indeed they all said they were never told any quid pro quo from Trump.

But this release certainly kills the Schiff claim that that the freeze was because of investigations, as Rep. Zeldin points out.

3. This is another smoke screen.

The testimony shows that people in OMB were concerned that the actual withholding of the funds itself was illegal. There is a law that states that if the executive withholds funds, they must go to congress and explain the reason. If congress does not agree, then the funds must be sent. The President never did this. Omb tried for a significant period of time to get an explanation, and they could not get one. Sandy, a career government worker, was replaced by a political appointee after raising concerns about the hold. The New York times has reported that at least two people resigned because of this issue.

11. Trumps Hold on Ukrainian Military Aid was Illegal


No one from the Trump administration has been able to point to any legal authority that allowed Trump to withhold the funding for the length of time and in the manner that he did. Even Trump’s defenders in the House, who have speciously claimed that the president had reasons for holding the aid other than pressuring Ukraine to investigate his political rivals, have not provided justifications that are legal. Instead, they’ve offered justifications that are more politically palatable. Moreover, Trump’s own White House Office of Management and Budget (OMB) was told that his actions were illegal, and appears to have tacitly acknowledged that fact, but continued to hold up the funding anyway.



It shows that the Trump White House created an irregular budgetary process to match its irregular foreign policy process with respect to Ukraine. The illegality of the hold also undermines the claim that Trump was concerned about Ukrainian corruption, since he was willing to break U.S. law to keep the money frozen. Finally, it shows that it was not policy or legal concerns that led to the money being released, but rather the fear of getting caught.

Explaining that the money was eventually released is like saying a bank robber is innocent if he brings the money back to the bank.

Which limits the executive’s ability to withhold funds appropriated by Congress.

That’s impeachable.

Your side finally came up with something real.

Still, it's odd I've seen at least three interviews with former (not Trump supporters) budget officials who have said withholding of foreign aid is quite common, mostly due to changes in circumstance. Regime change,etc. What they all emphasized was aid couldn't be held up in order to "bride the country to do a favor. None of em said the aid couldn't be delayed.

And what about Warren saying if Israel continued to build in the occupied territories, she would hold up their aid?

Gotta be more to the story.
