NYT-Dont Be Fooled, Trumps New Muslim Ban Is Still Illegal

Let’s be clear: This revised order is a Muslim ban. All the countries he has excluded are more than 90 percent Muslim. Three of them — Iran, Somalia and Yemen — are more than 99 percent Muslim. Even though Mr. Trump tailored his order to survive legal challenges, as his former adviser Rudolph Giuliani conceded on national television, his objective is clearly to exclude Muslims.

The Trump administration argues that the ban protects the country. Yet by excluding Iraq from the order, Mr. Trump has cleared travel from one of the two countries from which Islamic State terrorists operates. Moreover, the Department of Homeland Security concluded last month that “country of citizenship is unlikely to be a reliable indicator of potential terrorist activity.” Former national security officials from Democratic and Republican administrations have made clear that the January order does not make our country safer. Instead, the bigotry that Mr. Trump spews at news conferences and on Twitter have been a boon for terrorists’ recruitment efforts.

The twisted worldview does not match reality. Muslims have been part of America for centuries, since the first slave ships arrived in the 17th century. Today, Muslims represent 1 percent of the United States population: They are our teachers, doctors, neighbors and co-workers.

American Muslims will suffer a particular harm from this executive order: Those who have ties to the banned countries won’t be able to see their family members and close friends. American Muslims will also be deprived of the instruction from the leading Islamic scholars who are from those countries.

Thousands of Muslim men and women serve in the armed forces; many have given their lives defending our nation and our ideals. They contribute to the diversity that has always been our nation’s pride and strength. President George W. Bush paid tribute to this in the weeks after the Sept. 11 attacks when he said, “There are thousands of Muslims who proudly call themselves Americans, and they know what I know — that the Muslim faith is based upon peace and love and compassion.”

President Trump and his top advisers would be wise to listen to President Bush. The Muslim ban and President Trump’s relentless attacks on Islam are not just an assault on thousands of patriotic, innocent Americans — they violate our Constitution and our most fundamental American values and beliefs.
The ACLU and the states will be litigating this order.

For a President, an administration and a party that regularly denounces political correctness, this sure is the most politically correct way of beginning a ban on Muslims. Guess they just don’t have the courage to say what it really is ― so I will.

By now, everyone the world over is likely familiar with Trump’s campaign promise calling for a “total and complete shutdown” of Muslims entering the country. Those words didn’t just slip out of his mouth, and he didn’t misspeak, though he attempted to backtrack later by stating that it was going to apply to countries with a history of terrorism and that we were going to have “extreme vetting.”

He and his handlers knew exactly what they were doing. And more importantly perhaps, they knew that they could get away with it. This didn’t happen overnight and it didn’t start with Trump. He just seized upon what was already festering out there for years and ran with it – all the way to the highest office in the land.....

When elected official after elected official passed or attempted to pass “anti-Sharia laws,” as if Sharia was somehow invading and overtaking the Constitution, how many still voted for those candidates or worked alongside them and just looked the other way? And when the abhorrent idea of banning Muslims was first proposed by then-candidate Trump, how many journalists and networks ran with it for its sensational quality and thereby normalized such an outrageous concept?

Gen. Michael Flynn had referred to Islam as a “malignant cancer”; he became National Security Advisor (though he later had to resign, but that’s a separate story). Muslim students in Oklahoma recently tried to meet their State Rep. John Bennett but were instead handed a questionnaire at his office that asked such thought-provoking questions like, “Do you beat your wife?” Can you imagine if such a questionnaire were handed to any other group of students before an elected official agreed to meet with them? Neither can I.

Day in and day out you have talking heads, pundits and Islamophobes inundating our airwaves spreading misinformation and propaganda and nobody holds them accountable. People like Sean Hannity sit on their soapbox and attempt to portray all Muslim countries as homogeneous, backward places where women can’t drive and they have no rights. It is overt deception and the epitome of creating hysteria – and he gets away with it every single day. Then on supposed mainstream outlets, Muslims are still almost always discussed in the context of terrorism, war, extremism, etc. And everyone seems to just “look the other way.”

The lawsuits have forced some really major concessions from trump in this ban because trump got his butt kicked so badly the first time around. Lawyers who filed suits against the earlier ban offered somewhat divergent responses Monday to Trump's new order. Immigrant advocacy groups immediately denounced the directive, while lawyers for the states that obtained court rulings against the earlier order celebrated Trump's concessions.

"The bottom line is the president capitulated on numerous key provisions ... On those key provisions, this is a very significant victory," Washington state Attorney General Bob Ferguson crowed at a news conference in Seattle, where he argued that Trump's famous "SEE YOU IN COURT!" tweet proved to be pure bluster. "The president was essentially afraid to see us in court because he knew he would lose again."

Virginia Attorney General Mark Herring's statement had a similar air of triumph.

"This pared-down order is an incredible concession from President Trump that all but concedes the significant constitutional and practical flaws that the courts and I saw in his original ban," Herring said.
The lawyers involved deserve their victory lap given their success against trump.

9. The imminent and present danger Trump is trying to invoke as his reasoning, falls flat

 

it took 6 weeks to create this "well written" ban for an imminent danger that doesn't even exist. This EO ban will go to court, it will be under the same scrutiny as the last one. Guiliani's words, Trump's intent will still have been on the record and will not have changed with this new EO. Data doesn't support their suppositions of imminent danger. Putting lipstick on this pig isn't going to work..again. Trump will get mad, tweet something incoherent and he will blame Obama and throw out another slanderous accusation against Obama. It's a pattern we can count on.

ZERO times. So much for "muslim" ban label. Maybe you should have put
this link in your OP and correct your OP title. Your NYTimes link is an opinion piece.

If one percent of the American population is inconvenienced during this temporary
ban...too bad. I'm inconvenienced everytime I go to the airport because a few
terrorists entered our country who didn't have our best interests in mind. Taking
time for proper vetting is a small price to aid in security for ALL Americans. Don't
bother with an answer saying the countries listed in the EO weren't the problem
at the time. I don't want to risk it.

SUCH WAS the urgency of President Trump’s temporary travel ban on citizens of seven mainly Muslim countries that he characterized its suspension by federal courts last month as a grave threat to national security. Then his administration moved rather deliberately in formulating a replacement. Three times Mr. Trump and his spokesmen announced the imminent issuance of a new order; three times they postponed it. Now, three weeks after the president first said a new order was imminent, he has signed it — a watered-down version of the original, tweaked to withstand court challenges but no less arbitrary and misguided as a means of enhancing national security.

Fortunately, federal courts had the spine to stand up to Mr. Trump’s verbal assault on the judicial system’s integrity, forcing the administration to strip some blatant excesses from the original ban, such as the exclusion of people holding valid green cards and previously issued visas. In other cases, specific cohorts of immigrants would be granted travel or visa waivers on a case-by-case basis, replacing the original order’s blanket ban. Those are significant changes.

The new order also drops Iraq from the targeted list of countries whose citizens are barred from traveling to the United States, not because the administration suddenly deemed them a diminished threat but because alienating Iraq was a grievous diplomatic and military blunder. With U.S. forces fighting alongside Iraqi troops against a common enemy, the Islamic State, it dawned on the White House that it could ill afford to antagonize a critical ally.....

The courts will decide whether the order, which renews the suspension of all refu­gee resettlement for 120 days, passes legal muster. Already clear is that it remains antithetical to American interests, values, tradition and securit
