Las Vegas shooting victims file lawsuit against bump stock makers

NEW YORK (Reuters) – A lawsuit seeking to represent the victims of the Las Vegas rampage, the deadliest mass shooting in modern U.S. history, was filed against the makers of so-called bump stocks, which the shooter used to achieve a near-automatic rate of fire.

The proposed class action lawsuit, filed in state court in Clark County, Nevada, over the weekend and announced on Tuesday, accuses Slide Fire Solutions and other unnamed manufacturers of negligence leading to the infliction of emotional distress on thousands of people who witnessed or were injured in the Oct. 1 shooting at a Las Vegas music festival.

The lawsuit by three Nevada residents who attended the festival does not involve the injuries that hundreds of people suffered as a result of the shooting, or the families of the 58 people who were killed.

Authorities said shooter Stephen Paddock’s ability to fire hundreds of rounds per minute over a 10-minute period from his perch in a 32nd-floor hotel suite was a major factor in the high casualty count. Paddock, 64, killed himself before police stormed his suite.

The lawsuit was filed with support from the Brady Center to Prevent Gun Violence, a U.S. nonprofit organization that advocates gun control.

This will be dismissed.

Bumpstocks are legal. There is no negligence on the part of the manufacturer. It functioned as intended. The problem was not hardware (as usual) but software (which New Dems don't really give a shit about).

clause.

The gun industry has broad protections from lawsuits. The Protection of Lawful Commerce in Arms Act was enacted in 2005, protecting gunmakers and dealers from being held liable whenever a crime is committed with a firearm.

However, in this case, Gardiner said, that liability wouldn't apply because Slide Fire manufactures neither firearms nor ammunition.

10. It doesn't need special protections

given the lawsuit is for negligence. The product performed as functioned. There was no negligence on the part of the manufacturer as they can not be held liable for the actions of those who use the device. Was Renault sued for the Nice terror attack? Why not? Their vehicle was used in a manner that caused death and emotional distress.

Really, you should do that. I'm guessing you might, or might not, have a wife and children, and probably they hope you're going to be around in this Time and Place for some years yet.

The latest ban was set to go fully into effect in the early hours of Wednesday, barring various types of travelers from Syria, Libya, Iran, Yemen, Chad, Somalia, North Korea and Venezuela. Watson’s order stops it, at least temporarily, with respect to all the countries except North Korea and Venezuela.

In a 40-page decision granting the state of Hawaii’s request for a temporary restraining order nationwide, Watson wrote that the latest ban “suffers from precisely the same maladies as its predecessor.”
