Is Donald Trump a Traitor?

You have been covering intelligence for literally decades, you’ve co-written a book with someone who worked at the CIA specifically about the KGB,” Hayes noted. “Just start there with your knowledge how the KGB and successor agencies operated and how that looks, the indictment today and what we know about Russian interference with that history in context.”

“The Russian interference in the 2016 election fits perfectly into the past history of the way the KGB has operated over the years,” Risen explained.

“They are experts at covert action programs that are designed to inject disinformation into foreign countries,” Risen continued “and one of the cold war cases that I talk about in the piece is called Operation Infection in the early 1980s where the KGB went to great lengths through cutouts and intermediaries and using, you know, unwitting news organizations, to spread the rumor and the false story that the United States was behind the HIV-AIDS virus — and that had an insidious effect in the third world for a long time.”

John Podesta, campaign chairman for Democratic presidential nominee Hillary Clinton in 2016, said Sunday that President Donald Trump “has failed in carrying out his duty as president” by not shielding the U.S. from Russian meddling efforts.

Podesta said that by undermining special counsel Robert Mueller's probe into Russian election interference and failing to implement congressional sanctions against Russian President Vladimir Putin, Trump was relinquishing his responsibilities as commander in chief.

“He clearly, I think, has failed in carrying out his duty as president of the United States, which is to protect our democracy,” Podesta said during an interview on CBS’ “Face the Nation.”

He added: “If this is information warfare, then I think he’s the first draft dodger in the war.”

Podesta, a former chief of staff to President Bill Clinton, oversaw Hillary Clinton’s unsuccessful 2016 presidential bid. He pointed to the recent indictment of 13 foreign nationals in the federal probe into election interference as evidence that the Russians “likely” helped tip the election in Trump’s favor.

“You can’t prove that it did affect the outcome, but it certainly seems likely that it had some impact,” Podesta said.

"They were pushing votes, just to give one example, to Jill Stein," Podesta said, referring to the Green Party candidate. "Her vote in Michigan, in Pennsylvania and Wisconsin was greater than the gap between Donald Trump and Hillary Clinton in those states."

Swalwell said on MSNBC’s Morning Joy, “Do you believe it now? That’s what I ask, and most Americans ask of the president. And if he doesn’t, is he siding with Russia? Because that — we saw in that indictment that we have the clearest evidence that Russia meddled and the evidence is so strong that prosecutors believed they could prove it beyond a reasonable doubt, highest standard in the law. If the president is not to act, not to enforce sanctions, if he’s not to put in place a whole of government approach to prevent them from doing it again we have to ask what do they have on him that would prevent him from acting in America’s best interest?”

Eric Swalwell’s argument leads to treason
Treason is constitutionally defined as, “Treason against the United States, shall consist only in levying War against them, or in adhering to their Enemies, giving them Aid and Comfort. No Person shall be convicted of Treason unless on the Testimony of two Witnesses to the same overt Act, or on Confession in open Court.”

The reason why Trump or members of his administration are not likely to be charged with treason is that it would have to be proven that Russia is an enemy of the United States. The US is not at war with Russians, so defining Russia as an enemy is difficult.

Swalwell’s point is that Trump is doing the bidding of the Russians and violating his oath of office by not acting in the best interests of the United States. It’s an argument for impeachment, but depending on what can be proven, it can also be an argument for treason. If the evidence merits it, all that would stand between Trump and treason charges is Russia not being a declared enemy of the United States, but when a member of the House Intelligence Committee talks about a president not working in America’s best interests, it is a discussion that leads down the path to treason.

The new question is this: What has been—what will be done—to protect American democracy from such attacks in the future? The Russian attack in 2016 worked, yielding dividends beyond Vladimir Putin’s wildest hopes. The Russians hoped to cast a shadow over the Clinton presidency. Instead, they outright elected their preferred candidate. Americans once thought it was a big deal that Alger Hiss rose to serve as acting temporary secretary general of the United Nations. This time, a Russian-backed individual was installed in the Oval Office.

From that position of power, Trump has systematically attempted to shut down investigations of the foreign-espionage operation that operated on his behalf. He fired the director of the FBI to shut it down. His White House coordinated with the chairman of the House Intelligence Committee to misdirect the investigation. He mobilized the speaker of the House to thwart bipartisan investigations under broadly respected leadership. He has inspired, supported, and joined a national propaganda campaign against the Mueller investigation.

And all the while, Trump has done nothing—literally nothing—to harden the nation’s voting systems against follow-on Russian operations. On Sunday, he publicly repudiated his own national-security adviser for acknowledging at the Munich Security Conference the most incontrovertible basics of what happened in 2016.

It’s worth thinking about what a patriotic president would have done in Trump’s situation. He would be leading the investigation himself. He would be scouring his own campaign—doing everything in his power to reassure the country that whatever the Russians may or may not have done, his government owed Putin nothing. He would have imposed penalties on Russia for their outrageous acts—rather than protecting Russia from penalties voted by Congress. Above all, he would be leading the demand for changes to election laws and practices, including holding Facebook to account for its negligence.

At every turn, Trump has failed to do what a patriotic president would do—failed to put the national interest first. He has left the 2018 elections as vulnerable as the 2016 elections to Russian intervention on his behalf.....

Trump continues to insist that he and his campaign team did not collude with Russia in the 2016 election. We know that they were ready and eager to collude—that’s on the public record. (“If it’s what you say I love it especially later in the summer.”) The public does not yet know whether the collusion actually occurred, and if so, in what form and to what extent. But in front of our very eyes we can observe that they are leaving the door open to Russian intervention on their behalf in the next election. You might call it collusion in advance—a dereliction of duty as grave as any since President Buchanan looked the other way as Southern state governments pillaged federal arsenals on the eve of the Civil War.
