Rosenstein threatened to 'subpoena' GOP-led committee in 'chilling' clash over records, emails show

Incredible. Before this is over, Rosenstein needs to spend time in jail for obstruction of justice of a congressional investigation. Why Trump is tolerating Rosenstein's crap is beyond me. He should walk into the DOJ with police and tell them he is not leaving without the records Congress is demanding.

1. Is a defendant allowed to Subpoena witnesses and evidence?

Because that’s what he was “threatening “, to exercise his right to due process if he was charged with Contempt of Congress.

2. Congress is not a part of the DOJ

Rosenstein has no authority or right to threaten anybody in Congress for doing their job.

Congress has been overly patient with Rosenstein. He is in contempt.

12. If Congress charges him with contempt, as defendant, he can subpoena

Records and witnesses, including congressional staff, to prove his innocence.

That's not a threat, that's due process.

45. Congress...

is the most powerful part of American government. They have no other branch to appeal to or make complaint. There is no process only a vote of the Congress.

Whether it is prosecuted after the fact is up to the US Attorney for DC. In a case like this, it would be hard for Rosenstein to deny evidence to Congress and avoid prosecution if Congress acts.

What IS a PR nightmare is Rosenstein's contempt. He knows the DOJ has been corrupt and he is trying to hide the evidence.

Trump may be allowing Rosenstein enough rope to hang himself is the only reason I can think of for Trump not taking the bull by the horns.

5. I would like to see

Trump put out an executive order instructing the FBI and DOJ to provide all documentation requests made by Congressional committee chairs with no redactions, no denials, and provide the documents in under 5 business days of the request regardless of the sensitivity of the document. If something is such a huge risk, maybe allow them a process that requires presenting the document directly to the president for review and determination about the sensitivity.

I've said that Trump and Congress demanding investigations of the investigators is obstruction. The right here vigorously disagreed. But if Congressional investigators are investigated by DOJ investigators its obstruction?

The Republicans over the years have had a demented obsession with reading the E-mails of everybody they didn't like. Lets get the GOP's E-mails for a change. We'll see how they like it and what we can find.

20. The documents relating to the informant

have been released to the gang of 8 and Nunes. There was nothing incriminating there. Justice tried to drag its feet to keep the identity of the informant from being exposed. It didn't work though, as the identity of the informant was widely reported before the whole spat was over. Thanks Nunes.

Oversight authority is being abused by the GOP who are using it to try to cast doubt on a legitimate investigation.

If the requested documents are released they will show if the DOJ and FBI were conducting a fair investigation or if they were being weaponized to attack Trump and those in his campaign.

Since so far Mueller hasn’t indicted anyone for illegally colluding with the Russians I suspect the latter. Of course the requested documents might show my suspicions are unfounded.

If everything was done by the book I can’t see any reason why the requested documents are being slow walked. It simply stinks of corruption and the abuse of power.

Some may love living in a banana republic but I am not one.

It risks disclosing classified information. That includes information the investigators need to keep from the public.

We know, because Gowdy told us so, that Nunes runs right to the White House with everything he learns to tip them off so they know where they can lie.

Documents do eventually get turned over to responsible parties. This isn't a banana republic. If it is its because of Trump, who hold the ultimate power over what gets turned over and what doesn't.

The documents about the informant were shared and it turned out there was nothing to the Trump / Nunes spying hoax.

Some documents that were released contained redactions because of national security that when exposed had nothing to do with national security.
