Why the house is not issuing subpoenas

I saw an interview with a Dem strategist on MSNBC this afternoon. Didn't catch his name, and I didn't recognize him tall bald guy.

Anyway this is what he said:

The number one reason is time, chances are pretty good Trump would go to court and they want this wrapped by Thanksgiving. They want to do this quickly because of the Mueller fiasco, it took too long and confused the american people. They couldn't follow it.

2nd reason is they could lose in court, although Pelosi is correct that there is no statutory or constitutional requirement to open an impeachment inquiry with a vote of the house, a federal judge may not uphold the power to subpoena without the house authorizing it. Lots of theories on that one, they don't want to take a chance.

3rd reason the WH defying their demand letters is going to be used as the 2nd article of impeachment "obstruction of Congress". Again they avoid the federal courts.

According to him here is why they won't hold a vote to open a formal impeachment inquiry. Under the rules of the house it allows the minority to call witnesses, and grants them the power to subpoena also.

1. How can it be obstruction of congress?

I could only imagine that happening if they subpoena and Trump refuses.

2. Obstruction of congress isn't real

It's contempt of Congress or obstruction of Justice. But the house can come up with any article they want too.

They expect the MSM to run with the WH is defying the house subpoenas story, which they are.

3. My counter argument would be:

You can't call it Obstruction of Congress because Congress never made known its will to go forward with an inquiry. It's all just a handful of democrats usurping the chamber without the consent of the House at large.

Pelosi knows what the real vote count is as well as what the 2020 map looks like.
