Justice John Roberts = Justice David Souter?
Both are Harvard, both appointed by a Bush.

1. I think ironically, it is Bush v. Gore 2000 is the reason

Souter got in because Rudman stealthy advanced him and Sununu who was vetting didn't realize he was played
I think Souter was always a liberal.

I believe Roberts would not have taken the Gore/Bush case and was not personally happy with the outcome
I also believe Roberts does not like the court to be controversial

So in the law of unintended consequences, I think Roberts is making himself non-partisan because he
truly believe in the court system itself vs. what those that nominate him think of him

Also, historically justices do move right to left the longer on the court
(not including Scalia, Alito or Thomas now).
Not many go left to right.

He also knows at some point soon, after 2016 election, the court will shift and he will need to remain relevant
and find consensus.

2. You are right about Roberts thinking of his legacy and place in history now, rather

than when he is about to die.
