I recall having this discussion of the Arlen Specter/Joe Sestak situation. In any case, if a court is going to decide that what Blagojevich did wasn't "selling a seat" so much as routine political horsetrading, then such a thing would never get prosecuted.

Clinton can promise what she wants, but the Senate would never, NEVER confirm him.

7. the Senate would easily confirm Barack Obama, and if it was a Democratic senate-

or maybe even not, the Senate is fraternal.

I do not believe they would not confirm any Senator.

In 2014, I kept saying Elizabeth Warren would easily be confirmed to the court if at that time a vacany opened.

3. Bernie Sanders has a PoliSci undergrad degree

He has never gone to law school, passed a bar exam or been a lawyer, much less a judge. What would even remotely qualify him to be a Supreme Court Justice?

Look at David Souter or Sam Alito- both went stealth
Alito is the biggest corporatist conservative ever. Souter was a liberal.

8. Just like any natural born citizen over 35 can become president.

All they need is to be elected.

How much "juice" would a president need to use up to get a 74 year old socialist senator without a law degree, who most large donors wouldn't like, confirmed by the Senate? I'll bet it's more than any president would be willing to spend.

especially if its just a same side replacement (say if Breyer retired).

The Republicans especially if Democratic party wins senate in 2016, will save their fight for the flip choice

As normally almost everyone passes through, and if they stop one, it is basically unheard of to stop 2.

(which is how Alito and Thomas got through)

I still think Mitt will be Jeb's VP choice or vice-versa

I don't believe deals are against the law
But then they went with no cause and arrested Rodney B. of Illinois
I am still not sure what he did because it seemed like all he did was what people who play the lottery do-
