No hate crime charges in 'terrible attack' on Latino father, son due to legal loophole in Utah state

A man accused of beating a Latino father and son while making derogatory statements about Mexicans will not be charged with a hate crime due to limitations of state laws in Utah.

Alan Dale Covington, 50, faces four felony counts of aggravated assault, as well as several weapons and drug charges, according to Salt Lake County jail records. He allegedly beat Jose Lopez, 51, and his son Luis, 18, with a 5-foot metal pole outside the family's tire shop last week, the Salt Lake Tribune reported

Covington reportedly said, “I’m going to kill someone” before swinging the pole at the two men, according to police logs. Luis was struck in the head and later transported to a local hospital in serious condition. His father sustained a laceration to his forearm.

Veronica Lopez told the Tribune that her father and brother felt targeted by the attacker who also shouted "I hate Mexicans" and "I'm here to kill a Mexican" before asking if they were part of the "Mexican mafia." Her father, who immigrated to Utah from Mexico, has owned a tire business for four years.

1. Hate crime

laws are bullshit laws anyway. If there's a victim there's a crime. Period. Why is assaulting one person more heinous than assaulting another?

If we are in fact all equal under the law the penalty for assaulting any of us should be the same.

Hate crimes get enacted because the government doesn't do its job of protecting all of us equally, so the fix the government comes up with for not doing its job is to create separate classes of protected victims and value some citizens more than others depending on the motivation of the attacker.

It never ceases to amaze me that the fix for the government not enforcing the laws already on the books is to add yet more laws.

All hate crime laws should be abolished as separate but equal treatments under the law and that goes for any laws that treat a cop or the cop's fucking dog as more important lives than any other citizen. If we are all of us to be truly equal under the law the penalties for harming any of us should be the same and should be enforced equally across the board. When the government fails to do that those who fail, whether cops or judges or prosecutors should have their employment terminated.

2. Federal hate crime laws werre passed in the 1960s as part of the civil rights movement.

I believe the reason for these laws was to allow the Federal Government to prosecute crimes against black people by whites in the South where it was thought difficult to get convictions in local courts. Later, individual states passed similar laws, (there are 45 states with such laws, according to Wikipedia) and increased penalties were allowed if it was determined that the crimes were motivated by hate.

3. That's exactly my point

the locals weren't doing their jobs of enforcing the law so instead of removing those people we had to pass yet more laws treating some people as more special victims than others.

I'm pretty sure we won't find a lot of assaults and murders motivated by affection.

5. I'm good with extremely harsh penalties, but not grading based on race. Crime is crime,

and it doesn't matter if you do it for monetary reasons or racial reasons... it's still a violent crime and should be treated accordingly and equally. Period.
This shit is nothing more than a pass for lefty to exercise his racist tendencies and classify people to establish priority by race. Conservatives believe in equality, and equality without conditions. It's wrong, very wrong.
